Terms of Sales

The company Maison Anna Seberg exercises, on the website maison-anna-seberg.myshopify.com, a product distribution activity reserved for its Customers. The purchase of products offered by the company Maison Anna Seberg is made through the website maison-anna-seberg.myshopify.com (hereinafter the Site).

The general conditions of sale (hereinafter, the "GTC") are subject to the provisions of Articles L441-6 of the Commercial Code and L111-1 of the Consumer Code; they determine the rights and obligations of the parties to the contract relating to Maison Anna Seberg concluded by the Customers with the Site when taking out any subscription on the Site or when purchasing on the Site, the Customer declares to have read, understood and accepted without reservations the terms of the said order as well as the entirety of these GCS. The T&Cs are only valid in French and are subject to French law. The GCS are applicable in their terms on the day of subscription according to their wording present on the Site on that date. They may be subject to subsequent modifications.

Article 1 - Presentation of the Company

Article 2 - Legal capacity

By subscribing to our services on our Site, the Customer guarantees that he meets all of the following criteria: - To be legally and legally capable, authorized to enter into contracts; - Be of legal age within the meaning of French law (8 years or more); - Be a resident of France; - Not to act as or on behalf of a professional. Article 3 – Products

The service provided by Maison Anna Seberg (hereinafter, “the Order”) consists of the sale to the customer (hereinafter, the “Customer”) of Maison Anna Seberg brand products. Each of the product sheets describes the said product, it is however possible that non-substantial errors may appear on the Site, which the customer acknowledges and accepts. In any case, in the event of non-compliance of the product delivered with its description on the Site, the Customer may either exercise his right of withdrawal or implement the Company's guarantee of conformity which will proceed, the if necessary, either to the exchange or to the reimbursement of the price (in whole or in part) possibly invoiced.

Article 4 – Right of withdrawal

4.1. The individual Customer has a period of fourteen (14) working days from the date of delivery of his order to withdraw without having to justify reasons or pay penalties, with the exception of the return costs which remain at his expense and which he will have to pay.

4.2. The Customer who wishes to withdraw must send an email via the contact form, and mention the subject of his request as well as his contact details and order number.

4.3. The goods must imperatively be returned in their initial conditioning and packaging. Any product that is incomplete, damaged, damaged and/or the packaging has been damaged will not be taken back, exchanged or refunded.

4.4. Maison Anna Seberg will reimburse the Customer who has notified the exercise of his right of withdrawal within the period of fifteen (15) days at most from receipt of the notification of withdrawal or receipt by us of (the ) product(s). The Customer will be refunded the amount due by the means by which the initial order was placed (Credit Card, Paypal, or Cheque).

Article 5 - Geographical area

The service provided by Maison Anna Seberg is available in Europe with the exception of Switzerland, in the French language. Orders that do not meet this geographical condition cannot be taken into consideration.

Article 6 - Access to the service

The Site is generally accessible by the Customer at all times (7 days a day) except in the event of voluntary or involuntary interruption, in particular for maintenance needs or force majeure. Maison Anna Seberg being in fact, by its activity, bound by an obligation of means, it cannot be held responsible for any prejudice whatever its nature, resulting from the unavailability of the Site.

Article 7 - Subscription to the newsletter

By accepting the T&Cs, the Customer authorizes Maison Anna Seberg to send him emails to the address he provided when registering. Unsubscribing from the newsletter is possible at any time by sending an email via the contact form or at the bottom of each newsletter. 

Article 8 - Deactivation of customer account

In the event of non-compliance with the obligations arising from the acceptance of the GCS, incidents of payment of the price of an order, delivery of erroneous information when creating the account or acts likely to harm the interests of Maison Anna Seberg, the company reserves the right to suspend the Services or, depending on the seriousness of the acts, to terminate the Client's account. The company also reserves the right to refuse to contract with a person who has been excluded or sanctioned for such acts.

Article 9 - Price and Payment

9.1. The price of the Service is that presented on the Site, all taxes included, according to the formula chosen. The price can be changed. The changes are only valid for future orders: orders already paid will not be affected by the price changes.

9.2. Payment for the Services will only be made by the means available on the day of the order. The two (2) means of payment generally used by Maison Anna Seberg are credit card and check. If payment is made by check, and in order to facilitate its processing, it is necessary to indicate the number of the associated order, to complete it with the total amount of the order, and to send it to: Maison Anna Seberg 61 avenue de Prieux 44380 Pornichet France

9.3. Maison Anna Seberg will implement all means to secure the payments made by Customers and avoid the interception of confidential information by a third party. It is an obligation of means and not an obligation of results. Maison Anna Seberg cannot be held responsible in the event of fraudulent use of the means of payment used.

9.4. Within three (3) days of receipt of the subscription request, a request to debit the bank account will be sent to the paying agency. The subscription contract will be concluded upon receipt of the authorization to debit the account by the paying agency. In accordance with the regulations in force, the bank details of Customers are not kept by Maison Anna Seberg.

Article 10 - Proof

The Subscriber acknowledges the validity and probative force of the electronic exchanges and recordings kept by Maison Anna Seberg and admits that these elements receive the same probative force as a writing signed by hand under law n ° 2000-230 of 13 March 2000 adapting the law of evidence to information technologies relating to the electronic signature.

Article 11 - Delivery of products

11.1 The products will be sent to the Customers at the address given in the "My Account" information form completed by the Customer when ordering. In the event of a change of address, it is up to the Customer to make the change in his Customer account.

11.2. Maison Anna Seberg cannot be held liable for delays in delivery and the consequences that may result therefrom if the Customer fails to inform Maison Anna Seberg of the delay observed and to have ordered it to carry out the said delivery within fifteen ( 15 days. In the event that the package is returned to Maison Anna Seberg, a second delivery will be made at the Customer's expense. If the package is again returned to the sender, there will be no new shipment and the additional delivery costs will be deemed acquired by Maison Anna Seberg.

Article 12 - Returns and Refunds

Requests for returns and refunds must be made within 14 days of receipt of the order via the page contact. We will endeavor to respond to your request as soon as possible (usually less than 48 hours). Return costs are the responsibility of the customer. The refund or exchange will take place within 14 days of the date of receipt of the products. 

Article 13 - Gift cards

13.1. Gift cards are only available per period. The site manager reserves the right to put them online or not. 

13.2. Gift cards are valid for 1 year from the date of purchase. They are not extendable. 

13.3. Reimbursement of a gift card will only be possible if it has not been used in part or in full. In the case of a refund of a gift card, the code will be canceled and the buyer refunded by the same means as when paying.

13.4. Any purchase made on maison-anna-seberg.myshopify.com using a gift card cannot be refunded. In case of return, the card will be credited with the amount of the product, or a new gift card will be sent to you by e-mail credited with the amount of product.

Article 14 - Non-compliance or hidden defect

In accordance with the legal guarantees of conformity and hidden defect, any reservations on a product must be notified within twenty-four (24) hours of receipt of the products. Once the defectiveness of the products has been proven, the Customer may obtain an exchange after receipt of the goods, within the limits of available stocks. If the product is no longer available in stock, the Customer may obtain a replacement product. The absence or the defect of a product will give place to the exchange against the same product according to the stocks available, or against another product. In any event, Maison Anna Seberg's liability is limited by the value of the product. To obtain reimbursement under these conditions, the Customer must imperatively notify his choice to be reimbursed within thirty (30) days.

Article 15 - Force majeure

Maison Anna Seberg can not be considered as engaging its responsibility for total or partial contractual non-performance which would be caused by an event of force majeure, beyond our control.

Article 16 - Intellectual property

All elements of the Site, whether visual or sound, texts, layouts, illustrations, photographs, documents and other elements, including the underlying technology, are protected by copyright, trademarks and patents. Any total or partial reproduction of the elements accessible on the Site is strictly prohibited.

Article 17 - Information and freedoms

17.1. The information requested from the Customer in the questionnaire at the time of registration is necessary for the proper processing of his order and may be communicated to the contractual partner suppliers of Maison Anna Seberg intervening for the sole needs of the execution of this order.

17.2. In accordance with the applicable law in force, the Customer has the rights of opposition, rights of access and rights of rectification of the data concerning him. The Customer may demand that information concerning him/her be modified, completed, clarified or deleted if it is erroneous, outdated or incomplete or the collection, use or communication of which is prohibited. To exercise this right, the Customer simply needs to write to us via the contact form. We reserve the right to use the statistics provided by the information forms that Customers have completed in order to optimize our service and that of our partners.

Article 18 - Liability

18.1. Maison Anna Seberg in its capacity as a third party cannot be held liable for the content of any partner sites on the Site, in the same way its liability cannot be sought in the event of a conflict between the Customer and a partner site or brand.

18.2. The information allowing the Customer to identify himself, such as the username and password, is personal and confidential. This information can only be modified on the initiative of the Customer or Maison Anna Seberg, in particular in the event of forgetting the password. The Customer is solely responsible for the use of his identification elements, he is required to keep them secret. Any disclosure on its part can in no way be blamed on Maison Anna Seberg. Any order placed using the Customer's username and password is deemed to have been placed by the latter. Maison Anna Seberg cannot under any circumstances be held liable for damages caused by the disclosure of this personal and confidential data by the Customer and therefore of the use of this data by a third party. The responsibility of Maison Anna Seberg cannot, in any event, be sought for any damage of any nature whatsoever, in particular due to the use of the subscribed services; whether it is an attack on the reputation, the image, or a loss of data which could occur because of the use of the services offered by Maison Anna Seberg.

Article 19 - Safeguard clause

If one or more stipulations of the GCS were declared invalid pursuant to a law or regulation or a final court decision, the other stipulations would remain in force and scope.

Article 20 - Transfer of rights and obligations

In the event of total or partial transfer of the activity of Maison Anna Seberg, the contracts binding the Client and Maison Anna Seberg and/or successors and assigns remain binding between the parties. Contracts entered into by Maison Anna Seberg may not be assigned by the Customer without the prior written consent of Maison Anna Seberg. The contracts, rights and obligations of Maison Anna Seberg may not in any event be assigned or transferred without the Customer's prior consent.

Article 21 - Advertising on the Site

Maison Anna Seberg may freely insert advertising on its Site, and has complete freedom of choice as to the layout of these advertisements, the advertisers as well as the viewing of these advertisements.

Article 22 - Applicable law

French law governs the T&Cs. The application of the Vienna Convention on the international sale of goods is expressly excluded. The Customer acknowledges that the communications and computerized registers recorded by or from the Site will be considered by the parties as proof of the exchanges, orders, payments and transactions between the parties unless proven otherwise.

Article 23 - Jurisdiction clause

The parties acknowledge that any dispute, whatever its nature or cause, will be submitted to the competent French courts depending on the nature of the dispute.
